       This Privacy Notice (referred to as "Notice") states the terms and conditions under which "Chimalli Apps, SC" better known as "Chimalli Apps", residing in Street Nuevo Leon, Number 276, Colonia Hipodromo, Mexico City, Cuauhtemoc, CP 06170, in Mexico City, and internet portal, in its capacity as responsible for the use and protection of personal data, will process the personal data of the Contractor.

       In compliance of the Federal Law of Protection of Personal Data held by Private Parties (the "LFPDP") and other applicable law, the Contractor states that this notice has been given by the Responsible, that the Contractor have read, understood and agreed to the terms set forth in this Notice, and gives its consent for processing personal data. If personal data collection include economic or financial data, by signing the corresponding contract, either in printed form or by electronic means and corresponding processes for consent, be carring out acts to express holder´s consent.

For what purposes your personal data will be used?

       Chimalli Apps, S.C. may collect personal data through direct and / or personal delivery by any means of contact between the Contractor and the Responsible. Can also collect personal information indirectly through available public sources and other sources available on the market.

       The personal data we collect from you, will be used for the following purposes that are necessary for the requested Service:

  • Identify the user of the offered Application, in order to provide customized service under the most strict privacy rules, which allow us to deliver appropriate and required services to you.
  • The collected data will help to create, develop, manage, deliver and improve products, services and content.
  • And also they are used for creating enterprise software, in which data of the staff working for the applicant organization, in order to improve organizational processes.
  • Data can also be used to contact the owner of the information with service improvement purposes.
  • Conduct the activities and efforts focused on compliance with obligations arising from any legal and commercial relationship established in connection with the provision of services; billing; collection; customer service; technical service; granting of guarantees; management of value added services and content; management applications and Web sites; customer contact and provide, maintain, retain, activate, change, return or cancel the services requested by the Contractor.

Additionally, we will use your personal information for the following secondary purposes that are not necessary for the requested service, but will allow and facilitate us to provide you better care:

  • Marketing or advertising.
  • Report new products or services, changes in them, special offers and promotions.
  • Evaluation of the provided service.
  • Commercial prospection.

       To carry out the described purposes in this privacy notice, we will use the following personal information:

       Chimalli Apps will not transfer personal data of the Holder, except in the cases of Article 37 of the LFPDP, in which consent of the Owner is not required for national and international data transfer or any other case of exception forseen by the same or another legislation applied today or applicable to a particular case.

How you can access, modify or cancel your personal data, or oppose to its use?

       In terms of the provisions of Article 22 of the LFPDP, you have a right to know what personal data we holding, how we use them and the conditions (access). It is also your right to request the correction of your personal information if it is outdated, inaccurate or incomplete (Rectification); to remove it from our records or databases when it is considered it is not being properly used (cancellation); and oppose the use of personal data for specific purposes (Opposition). These rights are known as ARCO rights.

       Regards to procedure and requirements for exercising ARCO rights, please note the following:

  1. Through what means can the Holder prove identity, if applicable, his representative as wellas the personality of this last?

    You can prove your legal status by actual official identification, may also exercise your rights through a legal representative, who will identify itself with a signed letter before two witnesses, including the signed letter, the oficial identifications of the person granting legal power, the proxy and the two witnesses.

  2. What information and / or documentation shall the application contain?

    The Contractor has, at all times, the right to access, modify and cancel their data and to object to their treatment or revoke the consent they provided by submitting an application in the format that, for this purpose we will deliver at your expressed request, and it must contain the following information and documentation:

    1. Holder´s name and address or other means to communicate the response to your request;
    2. Existing documents proving identity (single copy in printed or electronic form) of your voter registration card, passport or Visa) or, where appropriate, Holders legal representation (single copy in printed or electronic form) of proxy with signature of the holder and the representative, with their current official IDs - voter registration card, passport or Visa);
    3. Address (a period not exceeding three months);
    4. The clear and precise description of the data seeking to exercise any of the ARCO Rights; and
    5. Any other item or document that facilitates the location of the personal data of the Contractor.

    In case of personal data rectification applications, the Contractor shall also indicate the modifications to be made and provide documentation supporting the request.

  3. In how many days we will give answer to your request?

    In case of requiring more information or if there is no clarity on your request, on about 5 days you will be notified using the means you indicated and the final resolution will be given to you on the next 20 labor days.
